Government gets nod to appeal Ivermectin ruling
THE FEDERAL Court has granted the Government and the Ministry of Health ( MoH ) permission to appeal against a Court of Appeal decision that permitted doctors to prescribe Ivermectin to patients .
The three-judge panel , led by Court of Appeal president Abang Iskandar Abang Hashim , stated that the application held merit due to its implications for public health .
" We , therefore , permit all six legal questions to be further discussed in the appeal process ," said Abang Iskandar , alongside Chief Judge of Sabah and Sarawak Abdul Rahman Sebli and Justice Hanipah Farikullah .
The online proceedings saw senior federal counsel Rahazlan Affandi Abdul Rahim and Liew Horng Bin representing the health ministry and Government , while lawyers Gurdial Singh Nijar and Abraham Au represented the doctors .
The Government asked whether legitimising the use and dispensation of Ivermectin by registered medical professionals defied the principles of justice , considering the lack of assurance regarding its safety for human use or efficacy in treating Covid-19 .
On Aug 25 , 2023 , the Court of Appeal ruled that registered medical practitioners could prescribe Ivermectin to patients , subject to compliance with Section 19 of the Poisons Act 1952 and the Poison Regulations 1952 .
The Court of Appeal clarified that the ruling did not promote Ivermectin as an alternative Covid-19 treatment but recognised medical practitioners ' discretion in prescribing Group B Poisons , including Ivermectin , to their patients .
The appeal stemmed from a lawsuit filed by two doctors , namely Dr S Vijaendran , who is Chairman of the Malaysian Association for the Advancement of Functional and Interdisciplinary Medicine and Dr Che Amir Farid Che Isahak , against the Health Ministry and the Government on Sept 21 , 2021 .
They sought clarity on whether registered medical practitioners could prescribe Ivermectin to patients under the Poisons Act 1952 and the Poison Regulations 1952 .
On June 14 , 2021 , officers from the Selangor health department ' s pharmaceutical services division confiscated Ivermectin from Dr Amir ' s clinic .
